A: Rising Star Academy Participation Waiver Agreement, Terms & Conditions
RELEASE For Participation in Rising Star Academy programs (Futsal Friday, Winter/Spring/Summer Academy, Camps, Clinics and all in person physical activities), hereafter referred to as “the Activity”. For the purposes of this document hereafter referred to as “the Release,” the party intending to participate in the activity shall hereafter be referred to as “the Participant”. Rising Star Academy and its trustees, partners, sponsors, officers, employees and agents, acting within the course and scope of their duties, shall hereafter be referred to as, “RSA”.

B: Release, Waiver of Liability and Assumption of Risk
In consideration of the opportunity afforded the Participant to participate in the Activity, the Participant’s Parent or Legal Guardian hereby releases and forever discharges RSA from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise, or may hereafter arise from or in connection with the Activity. The Participant’s Parent or Legal Guardian understands that this Release discharges RSA from any liability or claim that the Participant may have against RSA with respect to any bodily injury, personal injury, illness (including, but not limited to COVID-19), death, property loss or property damage that may result from participation in the Activity. The Participant’s Parent or Legal Guardian understands and acknowledges the potential risks to health and personal property that may be associated with the Activity, and they voluntarily assume those risks.

C: Medical Treatment and Pre-Existing Medical Conditions
In consideration of the opportunity afforded the Participant to participate in the Activity, the Participant’s Parent or Legal Guardian hereby authorizes RSA to administer first aid and make emergency medical determinations should such treatment and determinations be required while the Participant is participating in the Activity. The Participant’s Parent or Legal Guardian hereby releases and forever discharges RSA from any liabilities or claims, costs or damages that arise or may arise hereafter on account of any first aid, medical treatment or emergency medical decisions rendered to the Participant while participating in the Activity. The Participant and Participant’s Parent or Legal Guardian agrees that the Participant will take for themselves all appropriate precautions, including but not limited to; medications to treat and/or reduce the likelihood of exacerbating any pre-existing health conditions, including allergies.

D: Equipment and Safety
The Participant and Participant’s Parent or Legal Guardian hereby agree that it is the Participant’s responsibility to wear appropriate clothing, gear, and equipment associated with the Activity, such as, but not limited to; shoes/cleats, shin guards, shorts and training pants and shirts and that RSA reserves the right to have Participants without the appropriate clothing, gear, or equipment sit out from the Activity until remedies can be made to meet this condition.
Behavior and Safety - Dismissal From The Activity

It is understood and accepted that RSA reserves the right to dismiss the Participant from the Activity for reasons related to behavior and safety - at any time and for any length of time including full dismissal from the Activity in part, or in total, without refund at the sole determination of RSA.

E: Cancelled and Rescheduled Dates
RSA holds the right to determine if any date needs to be canceled or rescheduled for any reason. Families will be notified via email in this event. RSA is not required to offer any extra dates, does not offer refunds for part, of or all of the sessions, and under no circumstance is RSA required to offer any remedies for canceled or rescheduled dates due to weather conditions, natural disasters or other events of scale outside of RSA control or jurisdiction. RSA may offer remedies when deemed possible, but this is accepted and understood; this is entirely determined by RSA.

F: Refunds
It is accepted and understood that RSA will offer no refunds. RSA may offer remedies when deemed possible, such as credits toward future RSA activities or transfer your registration toward another player when possible. It is accepted and understood that such remedies are entirely determined by RSA on a case by case basis.

G: Photo, Video, Likeness and Content
It is understood and accepted that all video, photo, likeness or content generated of the Participant in conjunction with the Activity shall be the right and property of RSA and may be used by RSA without limitation in any manner RSA chooses. We understand that in some instances you may not want to be included in photos or videos, in this case we offer an option to OPT OUT: You may opt out of this term and condition by emailing us at success@risingstaracademy.us and we will accommodate.

H: Binding Terms and Conditions
The Participant’s Parent or Legal Guardian agrees and understands that these Terms and Conditions shall be binding and legally enforceable against the Participant and the Participant’s heirs, executors, administrators and legal representatives. These Terms and Conditions shall be governed by, and interpreted in accordance with the laws of the State of North Carolina. In the event that any clause or provision of these Terms and Conditions shall be held to be invalid by any court or competent jurisdiction, the invalidity of such a clause, or provision shall not otherwise affect the remaining provisions of these Terms and Conditions.
